The Court maintains an Argument Calendar for fully-briefed appeals and certain substantive motions at the discretion of the panel. The Court usually hears argument at 10:00 a.m. in Courtroom 1703 of the Thurgood Marshall United States Courthouse. During a week in which two panels will be considering matters simultaneously, the second panel will hear argument at 10:00 a.m. in Courtroom 1505.
A party that seeks oral argument in an appeal must file an Oral Argument Statement as prescribed under Local Rule 34.1. The Court will provide notice of a date set for oral argument or submission of the appeal to a panel.
The Court posts the names of panel members at noon each Thursday for cases scheduled on the Argument Calendar for the following week. Any updates to the Argument Calendar are posted immediately.
A request for a CD of oral argument can be made by writing to the Clerk's Office's Calendar Team or by visiting the Clerk's Office's Public Counter in Room 150 of the Thurgood Marshall United States Courthouse. The Court charges a fee for preparing the CD. Alternatively, a CM/ECF Filing User can request a CD of oral argument directly through the CM/ECF system and pay the applicable fee electronically. Anyone with a question about obtaining a CD of oral argument can contact the Calendar Team or the Records Team at the number listed in the Clerk's Office Directory.
Audio recordings of oral arguments also are available on the Court's website.
The Court maintains a separate Non-Argument Calendar (NAC) for a certain class of immigration cases specified under Local Rule 34.2.
